CalBuddy — Terms of Use

1. Acceptance of Terms and Parties

The Service is operated by Otto Apps Yazılım Uygulama Bilgi Teknoloji Reklamcılık Danışmanlık Sanayi ve Ticaret A.Ş. ("Company", "we", "us"), Istanbul, Turkey.

By using the Service you confirm that you are at least 16 years old (or the minimum age of digital consent in your country), have the legal capacity (or parental consent where required) to enter into a binding agreement, and agree to these Terms and to our Privacy Policy.

We may revise these Terms at any time. Material changes will be communicated via in-app notification, email, or website banner, and take effect on the stated date.

2. Health Disclaimer (Not Medical Advice)

CalBuddy is a calorie-tracking and nutrition-planning service offering food logging, meal suggestions, recipes, plans, and AI coaching.

• CalBuddy is not a healthcare provider, physician, or dietitian, and is not a substitute for professional medical or nutritional advice.
• Always consult a qualified physician or registered dietitian before starting any diet or weight-loss program — especially if you are pregnant or nursing, under 18, have an eating disorder or history of one, or have any medical condition.
• AI outputs are estimates. Calorie counts, macronutrient values, transcriptions of your voice notes, and recommendations may be inaccurate or incomplete. Do not rely on them for medical decisions.
• If you are experiencing a medical emergency, contact your local emergency services.

3. Account Registration

You create an account by signing in with Apple, by email (magic link), or by connecting a supported messaging channel, or via other supported sign-in methods. You are responsible for activity under your account and for keeping your access credentials secure.

You may delete your account at any time via the Service settings or by contacting info@ottoapps.studio.

4. The Service & Messaging Channels

Core features are available for free, with optional Premium features (advanced meal planning, detailed analytics, and similar).

The AI coach is delivered over third-party messaging platforms — WhatsApp (primary), Telegram, and Apple Messages. To use a channel you connect it and verify yourself (for example, a one-time passcode sent to your WhatsApp number, or the CalBuddy Telegram bot). Your use of each platform is also subject to that platform's own terms and privacy policies (e.g. WhatsApp/Meta, Telegram, Apple), over which we have no control. Message delivery depends on those platforms and may be delayed or unavailable; platform, carrier, or data charges may apply. We may add, change, or discontinue channels, and may modify, suspend, or discontinue any part of the Service at any time.

5. Intellectual Property and User Content

The CalBuddy brand, application, software, and databases are owned by the Company. When you submit food logs, photos, voice notes, messages, or other content ("User Content"), you grant the Company a worldwide, royalty-free license to process, store, and use it to provide and improve the Service, in accordance with the Privacy Policy.

6. Payments, Subscriptions, Auto-Renewal & Refunds

6.1 Billing & merchant of record

Website purchases are processed by our payment providers (Stripe, Web2Wave, Payrails/PayPal) and may appear on your statement under a merchant-of-record billing descriptor rather than the "CalBuddy" name. App Store purchases are processed by Apple.

6.2 Auto-renewal disclosure (please read)

Subscriptions are recurring. Unless you cancel, your subscription automatically renews at the end of each billing period, and the payment method on file is charged the then-current price for the next period. If your plan includes a free trial, you will be charged automatically when the trial ends unless you cancel before it ends. The price, billing frequency, and renewal terms are shown to you at checkout before you pay.

6.3 Reminders

Where required by law or app-store rules, we send a reminder before a free trial converts to a paid subscription and before certain renewals.

6.4 How to cancel (incl. California / ARL — click to cancel)

You may cancel at any time as described at the top of these Terms. California residents (and others where required) may cancel online without steps more burdensome than sign-up. Cancellation stops future renewals; it does not retroactively refund the current period except as set out below.

6.5 Refunds

• App Store purchases are refunded by Apple under Apple's policies.
• Website subscription fees are non-refundable except where required by law — including the EU/UK 14-day right of withdrawal for digital purchases (where applicable) and any mandatory local consumer-protection right.

7. User Representations and Restrictions

You represent that you are at least 16 years old, have legal capacity (or parental consent), and will use the Service for lawful, personal, non-commercial purposes only. You agree not to reverse-engineer, resell, or scrape the Service, upload infringing or harmful content, interfere with its systems, abuse the AI coach, or impersonate others.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in unlawful or harmful activity. You may stop using the Service and delete your account at any time.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey, and the courts of Istanbul (Çağlayan) have jurisdiction — without prejudice to the mandatory consumer-protection rights and the courts available to you in your country of residence (including the EEA, UK, and US), which continue to apply where the law so requires.
